1. Identificación de la Empresa y Ámbito de Aplicación

Psicovivir USA Corp, también constituida legalmente como Psicovivir Internacional (en adelante, "Psicovivir"), con domicilio legal en 13384 SW 128th St, Miami, FL 33186, EE.UU., opera la plataforma de bienestar emocional y educación psicológica accesible en www.psicovivirinternacional.com.

Estos términos y Condiciones regulan exclusivamente la adquisición de manuales, libros, talleres en línea, talleres presenciales, cursos y el acceso a la plataforma de suscripción Psicovivir Contigo+. Forman parte de un conjunto de documentos legales de Psicovivir que incluye además los términos Generales de Uso del Sitio Web y el Acuerdo de Servicio Individual. En caso de conflicto entre documentos, el Acuerdo de Servicio Individual prevalece para relaciones individuales, y los términos Generales prevalecen para el uso del sitio web.

2. Aceptacion de los Terminos y Mecanismo de Consentimiento

Al adquirir cualquier Producto o Servicio, el Consultante acepta quedar vinculado por estos Terminos y por la Politica de Privacidad de Psicovivir.

2.1 Mecanismo de aceptacion

La aceptacion de estos Terminos se formaliza mediante un mecanismo de confirmacion activa (checkbox) que el Consultante debe marcar de forma voluntaria antes de completar cualquier compra o registro. El checkbox no estara pre-marcado. El texto asociado al checkbox indicara expresamente que al marcarlo el Consultante acepta estos Terminos y la Politica de Privacidad, con enlace directo a ambos documentos.

Psicovivir mantendra registros tecnicos de cada aceptacion, incluyendo: identidad del Consultante, fecha y hora, direccion IP y version del documento vigente al momento de la aceptacion. Estos registros constituiran evidencia de la aceptacion en caso de disputa.

2.2 Notificacion de cambios y aceptacion por Consultantes existentes

Cuando los cambios sean materiales - afecten derechos del Consultante, politicas de reembolso, alcance de servicios o condiciones de arbitraje - Psicovivir notificara al Consultante por correo electronico con al menos quince (15) dias de anticipacion. El correo incluira un enlace al nuevo documento y un enlace al mecanismo de confirmacion activa. Para cambios menores, la publicacion en el Sitio Web es suficiente.

El uso continuado de los Productos y Servicios despues del periodo de notificacion constituye aceptacion de los nuevos Terminos. Sin embargo, para la clausula de arbitraje, Psicovivir requerira confirmacion activa mediante checkbox tambien de los Consultantes existentes.

3. Descripcion de los Productos y Servicios

3.1 Manuales y Libros Digitales
Materiales descargables de educacion emocional y desarrollo personal. Naturaleza exclusivamente educativa.

3.2 Cursos y Talleres en Linea
Eventos virtuales en directo o grabados, accesibles desde cualquier ubicacion con conexion a internet. Proposito educativo y de desarrollo de habilidades emocionales.

3.3 Talleres Presenciales
Eventos en persona con alcance geografico limitado segun se anuncie en cada evento.

3.4 Psicovivir Contigo+
Plataforma de suscripcion que incluye acceso a talleres mensuales en vivo, biblioteca de recursos digitales (manuales, clases grabadas, guias), comunidad virtual y acceso al sistema NARA. El acceso esta condicionado al mantenimiento de la suscripcion activa y al corriente de pago.

3.5 NARA - Acompanamiento con Inteligencia Artificial

NARA no es un profesional de salud mental. No realiza diagnosticos clinicos, no prescribe tratamientos, no reemplaza la atencion psicologica, psiquiatrica ni medica profesional.
NARA es una herramienta de apoyo emocional educativo. Sus respuestas son generadas por inteligencia artificial y no constituyen consejo profesional de ningun tipo.
NARA no esta disenada para situaciones de crisis, emergencia medica, ideacion suicida ni riesgo para la vida. En esos casos, el Consultante debe contactar de inmediato los servicios de emergencia de su localidad.
Si NARA detecta lenguaje asociado a crisis, riesgo o emergencia, el sistema esta programado para proporcionar informacion sobre recursos de emergencia y recomendar al Consultante que contacte a un profesional. Esto no constituye una garantia de deteccion en todos los casos.
Las conversaciones con NARA pueden ser revisadas por el equipo de Psicovivir con fines de mejora del servicio, control de calidad y cumplimiento de estas politicas, conforme a la Politica de Privacidad.
El uso prolongado y exclusivo de NARA como unico recurso de apoyo emocional no es recomendado. NARA es un complemento, no un sustituto de la relacion humana ni de la atencion profesional.
Psicovivir no sera responsable por decisiones tomadas por el Consultante basadas exclusivamente en las respuestas de NARA.
Los datos de las conversaciones con NARA estan sujetos a la Politica de Privacidad de Psicovivir y a la legislacion aplicable, incluyendo CCPA para usuarios en California.

LA RESPONSABILIDAD DE PSICOVIVIR USA CORP POR EL USO DE NARA ESTA LIMITADA AL MONTO PAGADO POR EL CONSULTANTE EN LOS ULTIMOS DOCE (12) MESES. PSICOVIVIR NO GARANTIZA LA EXACTITUD, INTEGRIDAD NI IDONEIDAD DE LAS RESPUESTAS DE NARA PARA NINGUN PROPOSITO ESPECIFICO.

4. Alcance y Limitaciones

LOS PRODUCTOS Y SERVICIOS DE PSICOVIVIR TIENEN NATURALEZA EDUCATIVA Y DE BIENESTAR EMOCIONAL. NO CONSTITUYEN TERAPIA PSICOLOGICA, PSIQUIATRICA NI ATENCION MEDICA. PSICOVIVIR NO DIAGNOSTICA NI TRATA ENFERMEDADES MENTALES A TRAVES DE SUS PRODUCTOS DIGITALES O TALLERES.

Los talleres, cursos y manuales son herramientas de educacion emocional y desarrollo personal, no tratamientos clinicos.
Los resultados pueden variar y dependen del esfuerzo, compromiso y circunstancias personales de cada Consultante.
Psicovivir no garantiza resultados especificos derivados del uso de sus Productos y Servicios educativos.
El Consultante es el unico responsable de las decisiones que tome a partir del contenido de los Productos y Servicios.
En caso de presentar sintomas de enfermedad mental, el Consultante debe acudir a un profesional de salud mental calificado o a un medico.

5. Uso Autorizado y Restricciones de Propiedad Intelectual

Todos los materiales de Psicovivir - incluyendo sin limitacion manuales, libros, cursos grabados, talleres en vivo, metodologias (Metodo Psicovivir, Metodo SEPA), videos, imagenes, disenos, marcas comerciales, nombres y logotipos - son propiedad exclusiva de Psicovivir USA Corp y estan protegidos por las leyes de derechos de autor, marcas comerciales y demas normas de propiedad intelectual aplicables en los Estados Unidos y en los tratados internacionales de los que EE.UU. es parte.

La publicacion de contenido en el Sitio Web no implica renuncia a ningun derecho de propiedad intelectual de Psicovivir. Psicovivir se reserva todos los derechos no expresamente concedidos.

Queda estrictamente prohibido:

Compartir, reproducir, redistribuir, revender o sublicenciar cualquier contenido de Psicovivir sin consentimiento previo y por escrito.
Grabar, capturar mediante pantalla o reproducir total o parcialmente los talleres en vivo, grabados o cualquier otro contenido audiovisual de Psicovivir.

Compartir credenciales de acceso a la plataforma Psicovivir Contigo+ con terceros.
Usar el contenido de Psicovivir para impartir cursos, talleres, conferencias o cualquier actividad con fines comerciales propios.

El incumplimiento de estas restricciones podra dar lugar a la cancelacion inmediata del acceso, sin reembolso, y a acciones legales civiles y penales por danos y perjuicios.

6. Suscripcion Psicovivir Contigo+

6.1 Condiciones generales
La suscripcion Psicovivir Contigo+ se cobra de forma periodica (mensual o anual) mediante cargo automatico al metodo de pago registrado. El acceso esta condicionado al mantenimiento de la suscripcion activa y al corriente de pago.

6.2 Cancelacion
El Consultante puede cancelar en cualquier momento. La cancelacion toma efecto al final del periodo de facturacion en curso. No se emitiran reembolsos por fracciones del periodo ya facturado, salvo en las excepciones de la Seccion 7.4.

6.3 Cambios de precio
Cualquier cambio de precio sera notificado con al menos treinta (30) dias de anticipacion por correo electronico. Si el Consultante no cancela antes de que el nuevo precio entre en vigor, se entiende que acepta el nuevo valor.

6.4 Suspension por falta de pago
Ante fallo en el cargo, Psicovivir podra suspender el acceso hasta regularizar el pago. Despues de treinta (30) dias sin pago, la suscripcion podra cancelarse definitivamente.

7. Politica de Cancelaciones y Reembolsos

7.1 Manuales y Libros Digitales
Una vez descargado o accedido el contenido digital, no procede reembolso. Si el Consultante no puede acceder al contenido por problema tecnico, debe notificarlo dentro de los siete (7) dias habiles siguientes a la compra a [email protected].

7.2 Talleres y Cursos en Linea
No se otorgaran reembolsos. El Consultante que cancele con al menos cuarenta y ocho (48) horas de anticipacion recibira un credito equivalente al monto pagado, aplicable a cualquier servicio o producto de Psicovivir, valido por doce (12) meses. La no asistencia sin previo aviso no generara credito ni reembolso.

7.3 Talleres Presenciales
No se otorgaran reembolsos. El Consultante que cancele con al menos siete (7) dias de anticipacion recibira credito equivalente, aplicable a cualquier servicio o producto de Psicovivir, valido por doce (12) meses. Cambios de fecha a otro taller similar pueden solicitarse con al menos tres (3) dias de anticipacion, sujeto a disponibilidad.

7.4 Excepciones - Derecho a Reembolso Completo

Psicovivir cancela definitivamente el servicio contratado sin ofrecer una alternativa aceptable al Consultante.
El Consultante experimento un error tecnico imputable a Psicovivir que le impidio acceder al servicio contratado.
La ley del Estado de Florida o la legislacion federal aplicable exija el reembolso en circunstancias especificas.

Las solicitudes de reembolso deben dirigirse a [email protected] dentro de los siete (7) dias habiles siguientes al evento que origina la solicitud. Psicovivir se reserva el derecho de declarar improcedentes las solicitudes extemporaneas.

7.5 Vigencia de sesiones y servicios
Los servicios de sesion adquiridos deben programarse y consumirse dentro de los treinta (30) dias siguientes a su adquisicion. Las sesiones no programadas ni utilizadas dentro de ese plazo caducaran, salvo que la imposibilidad de uso sea atribuible a Psicovivir - por falta de disponibilidad de consultores o fallas tecnicas de la plataforma - en cuyo caso Psicovivir extendera el plazo o emitira un credito equivalente valido por doce (12) meses.

7.6 Reprogramacion o Cancelacion por Parte de Psicovivir
Si Psicovivir reprograma un evento, el Consultante podra elegir entre: (a) asistir en la nueva fecha; (b) recibir credito valido por doce (12) meses aplicable a cualquier servicio o producto; (c) aplicar el pago a otro producto o servicio disponible. En caso de cancelacion definitiva por parte de Psicovivir, aplica la excepcion de reembolso completo de la Seccion 7.4.

8. Privacidad y Proteccion de Datos

Los datos personales del Consultante seran tratados conforme a la Politica de Privacidad de Psicovivir, disponible en www.psicovivirinternacional.com, y a la legislacion aplicable, incluyendo:

Florida Information Protection Act (FIPA).
California Consumer Privacy Act (CCPA): Consultantes en California tienen derecho a conocer que datos se han recopilado, solicitar su eliminacion y no autorizar su comercializacion. Para ejercer estos derechos: [email protected].
COPPA: Los Servicios no estan dirigidos a menores de 13 anos. Psicovivir eliminara de inmediato cualquier dato de menores de 13 anos recopilado sin consentimiento parental verificable.
CAN-SPAM Act y TCPA: Psicovivir cumple con ambas leyes. El Consultante puede cancelar la recepcion de mensajes de marketing respondiendo STOP o contactando a [email protected].

Psicovivir no vende ni alquila datos personales de sus Consultantes a terceros.

9. Limitacion de Responsabilidad

EN LA MAXIMA MEDIDA PERMITIDA POR LA LEY APLICABLE, LA RESPONSABILIDAD TOTAL DE PSICOVIVIR USA CORP FRENTE AL CONSULTANTE, POR CUALQUIER CAUSA Y BAJO CUALQUIER TEORIA LEGAL, NO EXCEDERA EL MONTO EFECTIVAMENTE PAGADO POR EL CONSULTANTE A PSICOVIVIR POR EL PRODUCTO O SERVICIO ESPECIFICO QUE ORIGINO LA RECLAMACION EN LOS ULTIMOS DOCE (12) MESES.

Psicovivir no sera responsable por: (a) danos indirectos, incidentales, consecuentes, especiales o punitivos; (b) perdida de beneficios, ingresos o datos; (c) resultados especificos no obtenidos; (d) interrupciones por fuerza mayor o fallas de terceros proveedores tecnologicos.

10. Indemnizacion

El Consultante acepta defender, indemnizar y mantener indemne a Psicovivir USA Corp, sus directivos, empleados, consultores y colaboradores frente a cualquier reclamacion, demanda, perdida, dano, costo o gasto - incluyendo honorarios razonables de abogados - derivado de: (a) el incumplimiento de estos Terminos; (b) el uso indebido de cualquier Producto o Servicio; (c) la reproduccion o uso no autorizado del contenido de Psicovivir; (d) cualquier declaracion falsa del Consultante.

11. Resolucion de Disputas y Arbitraje Vinculante

ESTE ACUERDO CONTIENE UNA CLAUSULA DE ARBITRAJE OBLIGATORIO. AL ACEPTAR ESTOS TERMINOS, EL CONSULTANTE RENUNCIA A SU DERECHO A LITIGAR EN CORTE, A UN JUICIO POR JURADO, Y A PARTICIPAR EN UNA DEMANDA COLECTIVA (CLASS ACTION) EN RELACION CON LOS PRODUCTOS Y SERVICIOS DE PSICOVIVIR USA CORP.

11.1 Resolucion informal previa
Antes de iniciar cualquier proceso de arbitraje, el Consultante debe notificar a Psicovivir por escrito a [email protected], describiendo la disputa y el remedio solicitado. Las partes intentaran resolver de buena fe durante treinta (30) dias. Si no hay acuerdo, cualquiera de las partes puede iniciar el arbitraje.

11.2 Arbitraje vinculante
Cualquier disputa no resuelta informalmente se sometera a arbitraje vinculante e individual bajo las Reglas de Arbitraje Comercial y los Procedimientos Suplementarios para Disputas de Consumidor de la AAA (www.adr.org). El arbitraje se llevara a cabo en Miami-Dade County, Florida. La Ley Federal de Arbitraje de EE.UU. rige esta clausula.

11.3 Renuncia a demanda colectiva
El Consultante y Psicovivir acuerdan presentar reclamaciones unicamente en capacidad individual. Ninguno puede ser demandante o miembro de clase en ningun procedimiento colectivo.

11.4 Excepciones
Cualquiera de las partes puede acudir a tribunales ordinarios para: (a) medidas cautelares urgentes de propiedad intelectual; (b) reclamaciones elegibles para Small Claims Court de Florida.

11.5 Ley aplicable y jurisdiccion subsidiaria
Este Acuerdo se rige por las leyes del Estado de Florida. Si la clausula de arbitraje fuera declarada no ejecutable, la jurisdiccion exclusiva recae en los tribunales del Condado de Miami-Dade, Florida, con renuncia expresa al juicio por jurado.

12. Disposiciones Generales

Fuerza mayor: Psicovivir no sera responsable por incumplimientos debidos a causas fuera de su control razonable, incluyendo desastres naturales, pandemias, actos gubernamentales o fallas de infraestructura tecnologica de terceros.

Divisibilidad: Si alguna disposicion fuera declarada invalida, las demas permaneceran en plena vigencia.

Acuerdo completo: Estos Terminos, junto con la Politica de Privacidad y los demas documentos del conjunto legal de Psicovivir, constituyen el acuerdo completo entre las partes.

No renuncia: El hecho de que Psicovivir no ejerza un derecho previsto en estos Terminos no constituye renuncia a dicho derecho.

Supervivencia: Las clausulas de Propiedad Intelectual, Limitacion de Responsabilidad, Indemnizacion y Arbitraje sobreviven a la terminacion de estos Terminos.

1. Company Identification and Scope

Psicovivir USA Corp, also legally incorporated as Psicovivir Internacional (hereinafter, "Psicovivir"), with legal domicile at 13384 SW 128th St, Miami, FL 33186, USA, operates the emotional wellness and psychological education platform accessible at www.psicovivirinternacional.com.

These Terms and Conditions govern exclusively the purchase of manuals, books, online workshops, in-person workshops, courses, and access to the Psicovivir Contigo+ subscription platform. They form part of a set of legal documents that also includes the General Terms of Use and the Individual Service Agreement. In the event of conflict between documents, the Individual Service Agreement prevails for individual service relationships; these Terms prevail for platform and product use.

2. Acceptance of Terms and Consent Mechanism

By purchasing any Product or Service, the Client agrees to be bound by these Terms and by Psicovivir's Privacy Policy.

2.1 Acceptance mechanism

Acceptance of these Terms is formalized through an active confirmation mechanism (checkbox) that the Client must voluntarily check before completing any purchase or registration. The checkbox will not be pre-checked. The text associated with the checkbox will expressly state that by checking it the Client accepts these Terms and the Privacy Policy, with a direct link to both documents.

Psicovivir will maintain technical records of each acceptance, including: Client identity, date and time, IP address, and version of the document in effect at the time of acceptance. These records shall constitute evidence of acceptance in the event of a dispute.

2.2 Notice of changes and acceptance by existing Clients

When changes are material - affecting Client rights, refund policies, scope of services, or arbitration conditions - Psicovivir will notify the Client by email at least fifteen (15) days in advance. The email will include a link to the new document and to the active confirmation mechanism. For the arbitration clause specifically, active checkbox confirmation will also be required from existing Clients. For minor or formatting changes, publication on the Website is sufficient. Continued use of Products and Services after the notice period constitutes acceptance of the updated Terms.

3. Description of Products and Services

3.1 Manuals and Digital Books
Downloadable materials for emotional education and personal development. Exclusively educational in nature.

3.2 Online Courses and Workshops
Live or recorded virtual events accessible from any location with an internet connection. Educational purpose focused on emotional skill development.

3.3 In-Person Workshops
In-person events with limited geographic scope as announced for each event.

3.4 Psicovivir Contigo+
Subscription platform that includes access to monthly live workshops, digital resource library (manuals, recorded classes, guides), virtual community, and access to the NARA system. Access is conditioned on maintaining an active, current subscription.

3.5 NARA - AI-Powered Emotional Support

NARA is not a mental health professional. It does not perform clinical diagnoses, does not prescribe treatments, and does not replace professional psychological, psychiatric, or medical care.
NARA is an educational emotional support tool. Its responses are generated by artificial intelligence and do not constitute professional advice of any kind.
NARA is not designed for crisis situations, medical emergencies, suicidal ideation, or risk to life. In such cases, the Client must immediately contact emergency services in their locality.
If NARA detects language associated with crisis or risk, the system is programmed to provide emergency resource information and recommend the Client contact a professional. This does not constitute a guarantee of detection in all cases.
Conversations with NARA may be reviewed by the Psicovivir team for service improvement, quality control, and compliance purposes, in accordance with the Privacy Policy.
Prolonged and exclusive use of NARA as the sole emotional support resource is not recommended. NARA is a complement, not a substitute for human connection or professional care.
Psicovivir shall not be liable for decisions made by the Client based solely on NARA's responses.
Data from NARA conversations is subject to Psicovivir's Privacy Policy and applicable law, including the CCPA for California residents.

THE LIABILITY OF PSICOVIVIR USA CORP FOR USE OF NARA IS LIMITED TO THE AMOUNT PAID BY THE CLIENT IN THE LAST TWELVE (12) MONTHS. PSICOVIVIR DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR FITNESS OF NARA'S RESPONSES FOR ANY SPECIFIC PURPOSE.

4. Scope and Limitations

PSICOVIVIR'S PRODUCTS AND SERVICES ARE EDUCATIONAL AND EMOTIONAL WELLNESS IN NATURE. THEY DO NOT CONSTITUTE PSYCHOLOGICAL THERAPY, PSYCHIATRIC TREATMENT, OR MEDICAL CARE. PSICOVIVIR DOES NOT DIAGNOSE OR TREAT MENTAL ILLNESS THROUGH ITS DIGITAL PRODUCTS OR WORKSHOPS.

Workshops, courses, and manuals are emotional education and personal development tools, not clinical treatments.
Results may vary and depend on each Client's effort, commitment, and personal circumstances.
Psicovivir does not guarantee specific results from the use of its educational Products and Services.
The Client is solely responsible for decisions made based on the content of the Products and Services.
If the Client is experiencing symptoms of mental illness, they should consult a qualified mental health professional or physician.

5. Authorized Use and Intellectual Property Restrictions

All Psicovivir materials - including without limitation manuals, books, recorded courses, live workshops, methodologies (Psicovivir Method, SEPA Method), videos, images, designs, trademarks, trade names, and logos - are the exclusive property of Psicovivir USA Corp and are protected by copyright, trademark, and other applicable intellectual property laws in the United States and under international treaties to which the U.S. is a party.

Publication of content on the Website does not imply any waiver of Psicovivir's intellectual property rights. Psicovivir reserves all rights not expressly granted.

The following are strictly prohibited:

Sharing, reproducing, redistributing, reselling, or sublicensing any Psicovivir content without prior written consent.
Recording, screen-capturing, or reproducing in whole or in part any live or recorded workshops or other Psicovivir audiovisual content.
Using Psicovivir content to train, feed, or develop artificial intelligence models or other derivative technologies.
Creating derivative works from Psicovivir materials without express written authorization.
Sharing access credentials to the Psicovivir Contigo+ platform with third parties.
Using Psicovivir content to teach courses, workshops, lectures, or any activity for the Client's own commercial purposes.

Violation of these restrictions may result in immediate cancellation of access without refund, and civil and criminal legal action for damages.

6. Psicovivir Contigo+ Subscription

6.1 General conditions
The Psicovivir Contigo+ subscription is billed periodically (monthly or annually) via automatic charge to the registered payment method. Access is conditioned on maintaining an active, current subscription.

6.2 Cancellation
The Client may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds will be issued for fractions of an already-billed period, except as provided in Section 7.4.

6.3 Price changes
Any price change will be notified at least thirty (30) days in advance by email. If the Client does not cancel before the new price takes effect, acceptance of the new amount is implied.

6.4 Suspension for non-payment
In the event of a failed charge, Psicovivir may suspend access until payment is resolved. After thirty (30) days without payment, the subscription may be permanently cancelled.

7. Cancellation and Refund Policy

7.1 Manuals and Digital Books
Once digital content has been downloaded or accessed, no refund will be issued. If the Client is unable to access the content due to a technical issue, they must notify Psicovivir within seven (7) business days of purchase at [email protected].

7.2 Online Courses and Workshops
No refunds will be issued. A Client who cancels at least forty-eight (48) hours in advance will receive a credit equal to the amount paid, applicable to any Psicovivir product or service, valid for twelve (12) months. No-shows without prior notice will not generate a credit or refund.

7.3 In-Person Workshops
No refunds will be issued. A Client who cancels at least seven (7) days in advance will receive an equivalent credit, applicable to any Psicovivir product or service, valid for twelve (12) months. Date changes to a similar workshop may be requested at least three (3) days in advance, subject to availability.

7.4 Exceptions - Right to Full Refund

Psicovivir definitively cancels the contracted service without offering the Client an acceptable alternative.
The Client experienced a technical error attributable to Psicovivir that prevented access to the contracted service.
The laws of the State of Florida or applicable federal law require a refund under specific circumstances.

Refund requests must be submitted to [email protected] within seven (7) business days of the event giving rise to the request. Psicovivir reserves the right to reject untimely requests.

7.5 Session and service expiration
Session services purchased must be scheduled and used within thirty (30) days of purchase. Unused sessions will expire at the end of that period, unless the inability to use them is attributable to Psicovivir - due to lack of coach availability or platform technical failures - in which case Psicovivir will extend the period or issue an equivalent credit valid for twelve (12) months, applicable to any product or service.

7.6 Rescheduling or Cancellation by Psicovivir
If Psicovivir reschedules an event, the Client may choose to: (a) attend on the new date; (b) receive a credit valid for twelve (12) months applicable to any product or service; (c) apply the payment to another available product or service. In the event of definitive cancellation by Psicovivir, the full refund exception in Section 7.4 applies.

8. Privacy and Data Protection

The Client's personal data will be processed in accordance with Psicovivir's Privacy Policy, available at www.psicovivirinternacional.com, and applicable law, including:

Florida Information Protection Act (FIPA).
California Consumer Privacy Act (CCPA): Clients in California have the right to know what personal data has been collected, to request its deletion, and to opt out of its sale. To exercise these rights: [email protected].
COPPA: Psicovivir's Services are not directed to children under 13 years of age. Psicovivir will immediately delete any data collected from children under 13 without verifiable parental consent.
CAN-SPAM Act and TCPA: Psicovivir complies with both laws. The Client may opt out of marketing messages by replying STOP to any text message or by contacting [email protected].

Psicovivir does not sell or rent the personal data of its Clients to third parties.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF PSICOVIVIR USA CORP TO THE CLIENT, FOR ANY CAUSE AND UNDER ANY LEGAL THEORY, SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THE CLIENT TO PSICOVIVIR FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE PRECEDING TWELVE (12) MONTHS.

Psicovivir shall not be liable for: (a) indirect, incidental, consequential, special, or punitive damages; (b) loss of profits, revenue, or data; (c) specific results not obtained; (d) interruptions caused by force majeure or third-party technology provider failures.

10. Indemnification

The Client agrees to defend, indemnify, and hold harmless Psicovivir USA Corp, its officers, employees, coaches, and collaborators from any claim, demand, loss, damage, cost, or expense - including reasonable attorneys' fees - arising from: (a) breach of these Terms; (b) misuse of any Product or Service; (c) unauthorized reproduction or use of Psicovivir content; (d) any false statement by the Client.

11. Dispute Resolution and Binding Arbitration

THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION CLAUSE. BY ACCEPTING THESE TERMS, THE CLIENT WAIVES THE RIGHT TO LITIGATE IN COURT, TO A JURY TRIAL, AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT IN CONNECTION WITH THE PRODUCTS AND SERVICES OF PSICOVIVIR USA CORP.

11.1 Informal resolution
Before initiating any arbitration proceeding, the Client must notify Psicovivir in writing at [email protected], describing the dispute and the relief sought. The parties will attempt to resolve the matter in good faith for thirty (30) days. If no agreement is reached, either party may initiate arbitration.

11.2 Binding arbitration
Any dispute not resolved informally shall be submitted to binding individual arbitration under the Commercial Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes of the American Arbitration Association (AAA), available at www.adr.org. Arbitration will be conducted in Miami-Dade County, Florida. The Federal Arbitration Act governs the interpretation and enforcement of this clause.

11.3 Class action waiver
The Client and Psicovivir agree to bring claims solely in their individual capacity. Neither party may act as a plaintiff or class member in any class, collective, or representative proceeding.

11.4 Exceptions
Either party may seek relief from a court of competent jurisdiction for: (a) urgent preliminary injunctive relief to protect intellectual property rights; (b) claims eligible for Florida Small Claims Court.

11.5 Governing law and fallback jurisdiction
This Agreement is governed by the laws of the State of Florida, without regard to its conflict of law provisions. If the arbitration clause is found unenforceable, exclusive jurisdiction shall lie with the courts of Miami-Dade County, Florida, with express waiver of jury trial.

12. General Provisions

Force Majeure: Psicovivir shall not be liable for failures caused by events beyond its reasonable control, including natural disasters, pandemics, governmental actions, or third-party technology infrastructure failures.

Severability: If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement: These Terms, together with Psicovivir's Privacy Policy and the other documents in Psicovivir's legal set, constitute the entire agreement between the parties.

No Waiver: Psicovivir's failure to exercise any right under these Terms shall not constitute a waiver of that right.

Survival: The Intellectual Property, Limitation of Liability, Indemnification, and Arbitration clauses survive termination of these Terms.
